
iPhone Owner Sues AT&T, Apple and Steve Jobs

I knew it would happen eventually. Rather than simply suing Apple, Steve Jobs or AT&T individually, Dongmei Li decided to go after all three of them.
The suit, which was filed last week (Sept. 24) in the United States District Court, accused the trio of “price discrimination, underselling, discrimination in rebates, deceptive actions and other wrongdoings for their role in the September 5th price drop on the iPhone.”
According to documents filed in the U.S. District Court for the Eastern District of New York, there are three central claims to Li’s case. The first:
“Apple’s price reduction has hurt early purchasers’ competition with Apple because they cannot sell it for as high a profit as they could have before the price cut.”
The second one is even better.
“Apple’s price reduction has hurt early purchasers’ competition with later purchasers because they cannot resell their iPhones for as low a price as later purchasers may.”
That’s not even the best one!
“Apple is selling its iPhone for an unreasonably low price to hurt competition between early and later purchasers so that the early purchasers cannot resell for as high a profit as they could have without the price cut. Apple is selling its iPhone for an unreasonably low price to hurt the competition that purchasers pose to it from reselling their iPhones.”
Li goes on to include AT&T’s cancellation fee and being cheated by the three. She is said to even include some graphs and charts. I think this case is ridiculous. Her claims don’t make much since to me. Do you think she’ll win? I am betting probably not, but you can never be to sure. We’ll see.

Can one actually sue the head of an incorporated business for the actions of said business…I mean, Incorporated businesses are their own legal entity.

The only reason she is suing is because she is a reseller on ebay, and wants to make a profit, and steal from Apple themselves. The last time I heard, she didn’t work for Apple, and has no right to tell a company to sell THEIR product at a certain price just to please her. Your stupidity if you just can’t wait, and think that there is going to be a second generation. Apparently, she didn’t study how marketing works, and how to make money in big business. She deserves what she gets because she is a reseller on eBay, and not paying taxes on the money she gains which should go to Apple because she is stealing their profit on a product she didn’t make or have any input on.

Couldn’t agree more with 2 Stu Peddassal Lady. I had been looking for a iPhone on ebay when the price drop happened. The sellers were selling them for more than the price of the phone, and then were included inflated shipping rates. The amazing thing is that people were buying them when they were widely avaliable in stores.
At any rate, Apple didn’t sell this person iPhones with the intent for her to resell them. If Apple wanted resellers, they would certify them. This person just has sour grapes because her get rich quick scheme went down the toleit with one swift announcement.
BTW, I did get my iPhone after the price drop and LOVE it!
